1) Product Information
All products that we offer for sale are from reputable manufacturers, and product descriptions are based on their specifications which are provided in good faith. Many products include extended warranties, which are in addition to your standard legal rights but which will be serviced directly by the manufacturer.
We try to ensure all information regarding sizing, weights, capacities, specifications, dimensions and measurements of products is as accurate as possible, but as they are supplied by our manufacturers are included as a guide only. If you are concerned about the precise information of any product you require, we recommend that you contact us prior to placing an order and/or purchasing a product.
All images are to the best of our knowledge a fair reflection of the product, but in the same manner we cannot guarantee the appearance and/or colours of products shown exactly replicate those of the physical products.
To the extent permitted by law, we accept no liability associated with such variations, including those caused by natural product variation.
Some products that we sell may be subject to safety or age restrictions. By ordering and/or purchasing these products you agree that you satisfy the legal age requirements for these products. If you are underage please do not attempt to order these products. To purchase items with an age restriction (e.g. a knife), we require you to use a credit card to make the payment.
2) Placing Your Order
Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to do this to minimise potential for errors.
Unless you cancel your order in accordance with our Cancellations, Returns and Refunds policies (see below) or we have contacted you to confirm that we are unable to accept your order, our acceptance of your order will occur automatically on the earlier of the date we deliver the products to you or 7 days following the date we send our Order Acknowledgement e-mail. The contract between us will only be formed at this time.
We reserve the right to reject any order for any reason and no order will be accepted until payment is received in full for all products and any related delivery charges.
All orders are subject to stock availability. If we are unable to supply any of the products that you have ordered we will inform you as soon as possible. If your order is unable to be serviced by the selected store, we will attempt to find an alternative store that can supply the products and contact you to confirm this. If the order is a collection from store we will confirm you are able to attend the new store before reconfirming the order.
In the event that an out-of-stock product is part of an order and we cannot contact you, we will send what products we have in stock, refunding the purchase price of any unavailable product where payment has already been made.
Please note that on occasion products may be supplied from different locations and therefore orders including multiple items may result in multiple deliveries to complete the order.
Some individual products or products within sets, kits and bundles may be age restricted items. By placing your order and making payment you are confirming you are of legal age to purchase an age restricted item.
3) Price of Products
We aim to align our prices on our site to in-store prices. However, these prices may be higher or lower than in our stores and our stores are under no obligation to match the prices quoted on this site, likewise this site is under no obligation to match in-store prices.
We take care to ensure that the prices of products on our site are correct. However, due to the large number of products on our site it is possible that, despite our best efforts, some of them may be incorrectly priced.
If we discover an error in the price of the products you have ordered we will contact you to you to give you the option of continuing to purchase the product at the correct price or cancelling your order. We will not process your order until we have your instructions in this matter. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.
Please note that if the pricing error is obvious and unmistakable and could reasonably have been recognised by you as a pricing error, we do not have to provide the products to you at the incorrect (lower) price even if we have failed to notify you that we do not accept your order within 7 days of our sending our Order Acknowledgement.
The price of all products includes VAT (where applicable) but does not include delivery charges.
You can only pay for products ordered on our site by debit or credit card or Paypal account. We accept the following cards: Visa and Mastercard credit cards and Maestro, Delta and Visa Electron debit cards. All card payments are subject to authorisation by your card issuer.
Payment for products (including delivery charges) will be debited from your payment card at the time of placing your order. This does not mean that your order has been accepted and, if for any reason, your order is not accepted or we are unable to supply the products you have ordered a full refund will be issued.
All products ordered will remain the property of supplying Mica Retailer until we have delivered the products to the address specified by you or they have been collected in store.
If your payment is not received and you have already received the products you ordered from the supplying retailer, you must pay for or return those products to us in accordance with our reasonable return instructions and in the same condition that you received them at your own expense. If you do not do this within 30 days of the date on which we cancel your order, we may collect or arrange for collection of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.
Under distance selling regulations you have the right to cancel an order up to 14 days after the day of delivery. This can be done via contacting the supplying Mica retailer or using the following template. (Download PDF template here). The product must be unused and in its original undamaged packaging. You will receive a full refund of the price you paid for the products and if the item/s returned constitute the entire order we will also refund you the delivery charge.
While in possession of the goods you are under the duty to retain them, and take reasonable care of them. We reserve the right if you do not return the goods or return them at our expense to make a charge not exceeding our direct costs of recovering the goods.
Once you have notified us that you wish to cancel the contract and the goods have been returned, we will action a refund back to the card you used to make that purchase. Refunds generally take five to seven working days to be credited to your payment card or PayPal account, depending on your card provider.
6) Faulty Goods
We know how annoying it can be when a product has, or develops a fault. You should contact the store who supplied your order in either case if you believe your product may be faulty, and they will try their best to make the process as pain free as possible. If after this you have to return the product to the store who supplied it, they will look at the product(s) and, if they are faulty or do not do what we say in writing that they will do (or, if relevant, do not do what the manufacturer's guarantee said they would do), they will sort the fault or replace or refund the faulty products.
As you would expect, no Mica store can refund, repair or exchange your products where the fault has been caused by an accident, neglect, misuse, normal wear and tear or where the products have not been assembled properly.
Nothing in these terms and conditions shall limit or exclude our liability to you for things which we cannot, by law, limit or exclude. In particular, nothing in these terms and conditions means that our liability to you for death or personal injury resulting from our negligence or that of our employees, agents or subcontractors is limited.
Where we are unable to perform our obligations under the Contract due to matters outside of our control or if we supply a product that is damaged or defective we will not in any circumstances accept liability for any claim to recover loss of profits or any special or indirect loss, damage or expense. Nothing in these conditions excludes or limits in any way our liability for:
a) death or personal injury caused by our negligence;
b) fraud or fraudulent misrepresentation; or
c) any matter for which it would be illegal for us to exclude or attempt to exclude our liability.
As a consumer you may have additional legal rights in relation to products that are faulty or not as described and nothing in these Terms affects these rights.
All notices you send us must be sent to the contact details on this site. We may give notice to you at either the email or postal address you provide to us when making a purchase. (Notice will be deemed received and properly served 24 hours after an email is sent or three days after the date of posting of any letter.) In providing the service of any notice, it will be sufficient to prove, in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an email that the email was sent to the specified email address of the addressees.
9) Online Dispute Resolution
The Alternative Dispute Resolution Scheme caters for disputes that arise as a result of an online purchase only, you may submit your complaint to the EU Online Dispute Resolution (ODR) platform via their website at http://ec.europa.eu/odr. Before going through the Dispute Resolution process please contact our Customer Service Team who will try and resolve the issue for you in the first instance.
10) Contract & Law
A contract is formed between you and the supplying Mica Retailer when you receive your order confirmation via email. No other person shall have any rights to enforce any of its terms.
This website; not limited to its design, coding and contained information; is the copyright of Mica DIY Ltd and/or their website partners. You do not have permission to reproduce, modify, copy or distribute our content for commercial purposes without written permission from us. No licence is granted to use any of our trademarks.
Each of the paragraphs in these terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
Your statutory rights are not affected by anything within these terms and conditions. Without limiting your statutory rights, Mica DIY makes no warranties that the information accessible via DIY.coop is accurate, complete or current.
This website only allows sales to residents of the United Kingdom of Great Britain and Northern Ireland, and Mica DIY Ltd being based in England, the terms of this website are governed by English law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by English law. You and we both agree that the courts of England will have non-exclusive jurisdiction.
